The purchase of confectionery products online is intended for natural and legal persons

Purpose of the Terms

The purpose of the Terms of Use of the online self-service system for confectionery products operated by the limited liability company “GUSTAVbeķereja” is to provide the Buyer with information about the rules for using the System and to define the obligations of the Buyer and the Bakery in relation to the use of the System

Privacy Policy

The Controller processes personal data lawfully, fairly and in a transparent manner in relation to the data subject

When registering in the System, the Client is required to familiarise themselves properly with the Terms of Use and the Privacy Policy

Terms used in relation to the Terms of Use of the System

Buyer	The Buyer of the Bakery’s confectionery products who makes a purchase in the System and who, before registering in the System, has familiarised themselves with the Terms of Use; if the Buyer is a natural person, they must be at least 13 years old at the time of making the purchase
Bakery branch working day	The working hours of the Bakery branch which the Buyer has specified in the System as the Product collection address
Confectionery product	Confectionery products of the Bakery
Buyer	The Buyer of the Bakery’s confectionery products who makes a purchase in the System and who, before registering in the System, has familiarised themselves with the Terms of Use; if the Buyer is a natural person, they must be at least 13 years old at the time of making the purchase
Product	The confectionery product or products selected by the Buyer
Product collection date	The Product collection date selected by the Buyer
Product collection address	The address of the Bakery branch selected by the Buyer as the place for receiving the Product
Product collection time	The Product collection time selected by the Buyer
Product purchase amount	The payment made by the Buyer for the purchase of the Product
Order	The Product, Product collection date, Product collection address and Product collection time
Agreement	The distance agreement concluded between SIA “GUSTAVbeķereja” and the Buyer on the basis of the Buyer’s registration in the System
Terms of Use	The Terms of Use of the System and the Privacy Policy
Registration in the System	Acceptance of the Terms of Use and a set of other actions, the completion of which is a prerequisite for using the System
System	The Buyers’ online self-service system available on the website gustavbekereja.lv, which enables the Buyer to purchase confectionery products online
Emergency call	A call by a Bakery employee to the telephone number provided by the Buyer in the System in order to clarify the Product purchase or inform the Buyer of other material circumstances relating to the fulfilment of obligations under the Agreement

Terms used in relation to the privacy policy for natural persons

Personal data	Any information relating to an identified or identifiable natural person (“data subject”). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier
Data subject	An identified or identifiable natural person; for the purposes of these Terms, the Buyer
Emergency call	A call by a Bakery employee to the telephone number provided by the Buyer in the System in order to clarify the Product purchase or inform the Buyer of other material circumstances relating to the fulfilment of obligations under the Agreement
Applicable legislation	The processing of the data subject’s personal data is carried out in accordance with the applicable data protection legislation

Subject of the Agreement
1. Under the Agreement, the Buyer orders access to the System and the Bakery undertakes to connect the Buyer to the System and provide the Buyer with services related to the System, while the Buyer undertakes to use the System in accordance with the Terms of Use and the terms of the Agreement.
2. Under the Agreement, the Buyer purchases the Product from the Bakery and the Bakery sells the Product to the Buyer.
Subject of the Agreement
1. The Buyer registers electronically by accepting the Terms of Use.
2. Services related to the System are available 24 hours a day:
  1. unless prevented by circumstances beyond the Bakery’s control;
  2. provided that maintenance work or work related to improving the System is not being carried out.
3. The Product may be collected on the specified Product collection date at the Bakery branch until the end of the branch’s working hours, but:
  1. on the next Bakery branch working day, from the start of the branch’s working hours, if the Product was purchased on the previous day by 15:00;
  2. on the next Bakery branch working day after 12:00, if the Product was purchased on the previous day after 15:00.
4. A Product that was not collected on the day specified in the Order cannot be collected on subsequent days, and the Product purchase amount is not refunded to the Buyer. Under the Agreement, the Buyer orders access to the System and the Bakery undertakes to connect the Buyer to the System and provide the Buyer with services related to the System, while the Buyer undertakes to use the System in accordance with the Terms of Use and the terms of the Agreement.
5. Under the Agreement, the Buyer purchases the Product from the Bakery and the Bakery sells the Product to the Buyer.

Conditions for purchasing the Product

To purchase the Product, the Buyer must complete the following steps in the System:

Step 1	select the type and quantity of the Product
Step 2	select the Product collection date
Step 3	select the Product collection address
Step 4	select the Product collection time
Step 5	for a natural person enter their first name, surname, email address and telephone number. for a legal person enter the company name, registration number, legal address, bank account, bank, email address and telephone number
Step 6	Confirm the purchase of the Product and make payment. The Client may pay using any of the following card types: VISA, VISA Electron, MasterCard or Maestro

The Buyer may not return or exchange a Product purchased in the System. Basis: Cabinet Regulation No. 255, “Regulations Regarding Distance Contracts”, dated 20 May 2014, Subparagraph 22.12. In view of this condition, before paying for the Product, the Buyer is asked to carefully review the Order and make sure that the Product meets their requirements.
The Buyer is given 10 (ten) minutes to pay for the selected Products from the moment the Buyer has completed Steps 1–5 specified in Clause 3.1 of the Terms of Use. If the Buyer does not pay for the Product within 10 (ten) minutes, the Product purchase is cancelled.

Buyer’s obligations
1. The Buyer confirms that the data submitted when registering in the System are true, valid and complete. The Buyer is responsible for the accuracy of the email address provided in the System and for the accessibility and security of their email account.
2. The Buyer has the right to:
  1. send the Bakery information about any deficiencies or inaccuracies identified in the System;
  2. if the Buyer has questions about the use of the System or suggestions, the Client is asked to contact the Bakery administration;
  3. freely exercise the rights provided for by the laws and regulations of the Republic of Latvia.
Bakery’s obligations
1. The Bakery undertakes to:
  1. provide services related to the System and sell the Product to the Buyer in accordance with the Terms of Use and the laws and regulations of the Republic of Latvia;
  2. after the Product has been purchased, the purchase invoice, which also serves as confirmation of the Product purchase, is immediately sent electronically to the email address provided by the Buyer in the System;
  3. hand over the Product to the Buyer.
2. The Bakery is not responsible if the Buyer does not receive information sent by the Bakery to the email address provided by the Buyer. The information is deemed to have been sent to the Buyer at the moment it is sent.
